Talent Submission Terms & Conditions
By submitting an application, materials, or information through Casting 42 or any associated submission platform, you acknowledge and agree to the following Terms and Conditions.
1. No Talent Representation
Nicole Sellars Casting is not a talent agency and does not represent, manage, place, or employ talent.
Submission of materials does not create an agent, manager, representative, fiduciary, or employment relationship between you and Nicole Sellars Casting.
All casting and talent sourcing services are performed solely on behalf of brands, networks, platforms, production companies, and other hiring entities.
2. No Guarantee of Auditions or Employment
Submission of materials does not guarantee auditions, callbacks, bookings, employment, compensation, or continued inclusion in any casting consideration.
All hiring decisions are made solely by the hiring brand, network, platform, or production company.
3. Database Inclusion Is Selective and Ongoing
Nicole Sellars Casting maintains a curated and actively managed talent database.
Inclusion is:
• Selective and subject to approval
• Based on professional qualifications, experience, and current market demand
• Subject to ongoing review, updates, and re-evaluation
Nicole Sellars Casting reserves the right to decline, remove, or re-categorize talent at any time, with or without notice, and without obligation to provide explanation.
4. No Fees Charged to Talent
Nicole Sellars Casting does not charge talent any fees, including but not limited to submission fees, access fees, audition fees, or placement fees.
Talent should never submit payment to be considered for casting opportunities through Nicole Sellars Casting.
5. Use of Submitted Materials
By submitting materials, you grant Nicole Sellars Casting permission to review, store, and share relevant materials solely for legitimate casting and talent sourcing purposes with potential hiring entities.
Submitted materials may include, but are not limited to, headshots, demo reels, videos, resumes, social media links, and professional background information.
6. Accuracy of Information
You represent and warrant that all information submitted is accurate, truthful, current, and not misleading.
Any false, exaggerated, or misrepresented information may result in immediate removal from consideration or from the database.
7. Independent Contractor Relationship
If engaged by a brand, network, or company, you acknowledge that:
• Any working relationship is directly between you and the hiring entity
• All compensation, contracts, and obligations are negotiated solely between you and the hiring entity
• Nicole Sellars Casting does not negotiate contracts or compensation on behalf of talent
8. Talent Due Diligence Responsibility
You acknowledge and agree that it is your sole responsibility to conduct your own due diligence regarding any brand, network, platform, production company, or hiring entity you may be introduced to through Nicole Sellars Casting.
This includes, but is not limited to, researching and evaluating:
• The legitimacy of the hiring entity
• The nature of the project or engagement
• Compensation terms
• Working conditions
• Legal, financial, and reputational considerations
Nicole Sellars Casting does not guarantee the conduct, business practices, or financial stability of any hiring entity and makes no representations regarding the suitability or safety of any opportunity.
9. Confidentiality
You agree to maintain confidentiality regarding all non-public casting discussions, project details, brand information, and communications unless such information is publicly released or authorized by the hiring entity.
10. Third-Party Platforms and Data Security
Nicole Sellars Casting utilizes third-party platforms, including but not limited to Casting 42, to collect, store, and manage talent submissions.
Nicole Sellars Casting does not own, operate, or control these third-party platforms and is not responsible or liable for their data security practices, system failures, unauthorized access, or data breaches.
By submitting your information, you acknowledge and agree that:
• Any data breach or security incident occurring on a third-party platform is the responsibility of that platform
• Nicole Sellars Casting shall not be held liable for any loss, misuse, or unauthorized disclosure of information resulting from such incidents
• Submission of information is done at your own discretion and risk
Talent is encouraged to review the privacy and security policies of all third-party platforms used for submissions.
11. Indemnification and Hold Harmless
You agree to indemnify, defend, and hold harmless Nicole Sellars Casting, its owners, officers, contractors, affiliates, and representatives from and against any and all claims, disputes, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:
• Your actions, conduct, or performance
• Any agreement, dispute, or issue between you and a hiring brand, network, platform, or production company
• Any failure to conduct appropriate due diligence regarding a hiring entity
• Any alleged misrepresentation or omission in your submitted materials
• Any failure to comply with contracts, policies, or expectations of a hiring entity
Nicole Sellars Casting is not responsible for disputes, dissatisfaction, claims, or outcomes arising between talent and hiring entities.
12. Release of Liability
You release Nicole Sellars Casting from any and all claims related to:
• Non-selection or non-hiring
• Hiring decisions made by third parties
• Use of submitted materials for casting purposes
• Changes in casting needs, platform demand, or industry conditions
13. Modification of Terms
Nicole Sellars Casting reserves the right to modify or update these Terms and Conditions at any time without prior notice.
Continued participation in the submission process constitutes acceptance of any updated terms.
14. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the United States and the state in which Nicole Sellars Casting operates.
15. Acknowledgment
By submitting your application, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
